By placing an order through the MerseyStay Store, you agree to these Terms & Conditions.
1. Who Can Use the Store
- The Store is available only to guests with a confirmed reservation at a MerseyStay property.
- Orders are linked to your booking and cannot be transferred to anyone else.
2. Ordering and Confirmation
- Orders are placed through the TouchStay Store and must be paid in full at the time of purchase.
- All services and items are subject to availability and confirmation.
- Your order is only confirmed once you receive written or electronic confirmation from MerseyStay.
3. Early Check-In & Late Check-Out
- Requests are subject to availability and operational schedules.
- Confirmed early check-ins and late check-outs may be cancelled or adjusted if necessary for maintenance or safety reasons.
- If this happens, you will receive a full refund for the affected service, but no further compensation is payable.
4. Food, Drink & Alcohol Orders
- Food and drink orders must be placed at least 24 hours before arrival.
- Alcoholic beverages are supplied by MerseyStay in accordance with UK licensing law.
- You must be 18 years or older to purchase or receive alcohol. ID may be requested upon delivery.
- Once prepared, packaged, or delivered, food and alcohol orders are non-refundable and cannot be modified.
- Guests are responsible for safe storage and consumption of all items supplied.
5. Gift Shop Items
- Physical products are subject to stock availability.
- In the rare event an item is unavailable, MerseyStay may offer an alternative of equal value or provide a full refund.
- Perishable, personalised, or hygiene-sensitive products cannot be returned once opened or used.
6. Cancellations & Refunds
- You may cancel your order within 24 hours of purchase, provided the service or item has not yet been prepared, delivered, or consumed.
- Refunds will be processed within 7 business days to the same payment method.
- If preparation or delivery has begun, the order is non-refundable.
7. Pricing & Payment
- All prices are listed in GBP and include applicable taxes.
- Payments are processed securely via approved third-party providers (e.g. Stripe).
- MerseyStay does not store or have access to your full payment details.
8. Guest Responsibility
- Guests must ensure the accuracy of delivery times and access details.
- Misuse of any purchased items (including alcohol) or damage caused during use remains the guest’s responsibility and may result in charges to the booking card on file.
9. Limitation of Liability
- MerseyStay is not liable for indirect losses, inconvenience, or injury arising from the use or consumption of any purchased item or service.
- Where an issue arises due to product defect or service error, MerseyStay’s liability is limited to the cost of the item or service purchased.
10. Privacy & Data Protection
- Personal data is used only to process and deliver your order.
- Data is stored securely and retained for no longer than 12 months unless required for legal compliance.
- MerseyStay complies fully with UK GDPR regulations.
11. Force Majeure
- MerseyStay shall not be held liable for failure or delay in fulfilling any order due to circumstances beyond its reasonable control, including severe weather, power failure, or supplier issues.
- In such cases, you will receive a full refund where applicable.
12. Governing Law
- These Terms & Conditions are governed by the laws of England & Wales.
- Any disputes shall be subject to the exclusive jurisdiction of the courts of England & Wales.
